Separation Agreement

THIS SEPARATION AGREEMENT (the "Agreement") is made and entered into as of ________ day of ________________, ________.

RECITALS

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the Parties agree as follows:

The Parties agree to live separate and apart from each other, and each shall be free from interference, authority, and control by the other as fully as if unmarried.

Retirement Accounts: Each party shall retain their own retirement accounts.

3. DIVISION OF DEBTS

Each Party agrees to indemnify and hold harmless the other Party from any liability for the debts they have assumed.

4. TAX MATTERS

For tax year ______, the Parties shall file separately.

5. CONFIDENTIALITY

The Parties agree to keep the terms of this Agreement confidential and shall not disclose its contents to third parties except as required by law or to obtain professional advice.

6. NON-DISPARAGEMENT

Neither Party shall make disparaging remarks about the other Party to third parties, including but not limited to the children, family members, friends, or employers.

7. NOTICES

Any notice required or permitted under this Agreement shall be in writing and delivered by personal delivery, certified mail (return receipt requested), or email.

Notices shall be sent to the Parties at the addresses set forth above, or to such other address as a Party may designate in writing.

8. ASSIGNMENT

No Party may assign this Agreement without the prior written consent of the other Party, and any attempted assignment without consent is void.

9. AMENDMENTS; WAIVER

This Agreement may be amended only by a written instrument signed by the Parties.

No waiver of any breach of this Agreement will be deemed a waiver of any subsequent breach, and no waiver will be effective unless in writing and signed by the waiving Party.

10. COUNTERPARTS; ELECTRONIC SIGNATURES

This Agreement may be executed in counterparts, each of which will be deemed an original, and signatures delivered electronically or by PDF will be binding.

11. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of  .
